End User License Agreement & Interactive Software Service Terms

1. PARTIES AND SCOPE OF AGREEMENT

This Agreement is entered into between Emir Furkan Kara ("Licensor / Service Provider") and any natural person or legal entity ("User / Creator / Licensee") who purchases or uses licenses for interactive simulation software, client/server modules, and digital services provided via www.elfoyun.com ("Platform"). By completing a purchase, downloading, or running the software, the User irrevocably agrees to all terms, DRM technical controls, intellectual property protections, and digital goods withdrawal waiver herein.

2. GRANT OF LICENSE & INTELLECTUAL PROPERTY

Limited Single-Seat License: A purchase grants a limited, non-exclusive, non-transferable, revocable license to operate the software on a single personal computer tied to a Hardware Identifier (HWID) for the specified term (e.g., 30 calendar days). No source code, ownership, or resale rights are transferred.
Intellectual Property: All match simulation algorithms, AI engines, 3D asset models, codebases, trademarks, and user interfaces are the exclusive intellectual property of Emir Furkan Kara, protected under international copyright treaties (WIPO, Berne Convention) and applicable intellectual property laws.

3. MANDATORY THIRD-PARTY DISCLAIMERS

A. MOJANG STUDIOS & MICROSOFT NOTICE:

"NOT AN OFFICIAL MINECRAFT PRODUCT/SERVICE. NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT."

Software provided by the Licensor is an independent interactive simulation tool. It is neither affiliated with nor endorsed by Mojang Studios or Microsoft Corporation. Minecraft is a registered trademark of Mojang Synergies AB.

B. TIKTOK & LIVESTREAM PLATFORMS DISCLAIMER:

The software operates as an independent streamer assistant tool. It has no corporate sponsorship, official partnership, or endorsement from TikTok Pte. Ltd., ByteDance Ltd., or their affiliates. TikTok is a registered trademark of its respective owner.

Streamer Account Responsibility: Any account restrictions, livestream suspensions, warnings, penalties, or bans imposed by TikTok or any third-party broadcast platform are solely determined by the user's broadcast conduct and the platform's independent community guidelines. The Licensor disclaims all liability for third-party account enforcement actions; such events do not constitute grounds for refund or contract termination.

4. TECHNICAL PROTECTION MEASURES (DRM & ANTI-TAMPER)

To protect proprietary assets against unauthorized reverse engineering, decompilation, memory hacking, and piracy, the software incorporates non-intrusive local Technical Protection Measures (TPM / DRM) pursuant to international copyright statutes (including 17 U.S.C. § 1201 and WIPO Copyright Treaty Art. 11):

Process Inspection (Tasklist): Ephemeral local validation of running process names to detect active memory scanners or decompiler tools (e.g., Cheat Engine, x64dbg, Process Hacker).
Window Title Scanning: Local scanning of open top-level window titles for active debugger utilities.
Kernel Debugger Detection: Standard OS API query (IsDebuggerPresent, CheckRemoteDebuggerPresent) to prevent attached debuggers.
Memory Integrity & Anti-Injection: Active defense against foreign DLL injection, JVM Java agent hooking, and memory dumping.
Network Verification (No-Proxy): Direct TLS channel enforcement to bypass rogue local proxy filters (Fiddler, Charles) attempting ticket spoofing.

Strict Privacy Guarantee: These technical checks are executed strictly in local volatile memory (RAM), are read-only, and never access the user's personal documents, photos, communications, or browsing history. Detected tampering attempts result in immediate session termination, deletion of temporary cached files, and permanent license revocation without compensation.

5. SYSTEM PREREQUISITES & WARRANTY DISCLAIMER

The software is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind. Compatibility requires a 64-bit Windows 10/11 operating system, local Java 21 runtime, and a one-time launch of Minecraft 1.21 client libraries. Failure of the user's environment to fulfill these prerequisites is solely the user's responsibility.

In no event shall the Licensor be liable for indirect, punitive, or consequential damages, viewer retention variability, algorithmic platform modifications, or loss of broadcast revenue.

6. DISPUTE RESOLUTION & GOVERNING LAW

This Agreement is governed by the laws of the Republic of Turkey without regard to conflict of law principles. Any dispute arising out of or related to this Agreement shall be resolved exclusively by the competent Consumer Arbitration Boards and the Courts of Istanbul (Caglayan), Turkey.
